What is an infant settlement trust?

Infant Settlement Trusts can be accessed by a parent/guardian or solicitor and allow access to the compensation which can be used for treatment, maintenance and education of the child without additional approval from the court. The Trust can also continue after the age of 18 and this can be extremely useful if claiming any means tested benefits.

What is the process for a settlement trust?

When a minor is awarded significant compensation for a personal injury, it can be recommended to the court that the funds are placed into a trust as opposed to the court funds office.

By setting up an Infant Settlement Trust, the trustees (usually a parent/guardian and a solicitor) will have access to a wide range of investments and have more control of the monies. The compensation can then be used for treatment, maintenance and education of the child without additional approval from the court.

The Trust can also continue after the age of 18 and this can be extremely useful if claiming any means tested benefits.
